Alaska Consumer Protection Act Decision from Alaska Superior Court

In Crawford v. Alaska Law Offices et al., a debtor sued the State's largest debt collecting law firm after it seized more monies from her on a debt than she actually owed.  The debtor claimed that the law firm's excess seizures were "unfair" and violated Alaska's Consumer Protection Act.  The law firm claimed that it was immune from the Consumer Protection Act because they were "lawyers" and that, in any event, seizing excess monies from a debtor was not "unfair," so long as the monies were eventually returned to the debtor.
 
The Superior Court rejected the lawyers' immunity claim and held that lawyers were liable under Alaska's Consumer Protection Act when they were engaged in debt collecting.  The Superior Court also held that it was "unfair" and violative of the Consumer Protection Act to seize more monies from a debtor than are actually owed.  Even if the monies are returned, the debtor is still deprived of those monies for a lengthy time."
