Aunque OSHA no emite citaciones a empleados que no cumplen con sus responsabilidades, cada empleado "debe cumplir con las normas de seguridad y salud ocupacional y con todos los reglamentos, las reglas y las disposiciones emitidas al amparo de la Ley" que son aplicables. Las responsabilidades y los derechos de empleados en estados que cuentan con sus propios programas de seguridad y salud ocupacional suelen ser los mismos que los de los trabajadores en estados regidos por la OSHA federal.
