Answers to Basic Questions about Mediation and The Justice Center of Atlanta

Why Use Mediation?

Mediation is a powerful process that provides win/win solutions with a high-rate of long term success. While we cannot guarantee success for every participant, our clients experience the following benefits over users of traditional adversarial processes (like due process hearings, arbitration and litigation):

Faster conflict resolution; on average over 65% of mediated cases result in lasting settlements
Substantial reduction in financial and emotional costs of conflict
Mutually acceptable solutions
The process works for a wide range of conflicts.

How Mediation Works

People with adversarial views talk together in the presence of a trained, neutral mediator who facilitates discussion. All parties work to reach agreement and find solutions that everyone can support.

Characteristics of the process include:

Discovery of mutual interests.
Joint problem solving.
Orientation to the future.
Creative, flexible solutions.
Respect for and sharing of differing expertise by the parties and representatives.
Control of the process by a neutral mediator.
Control of the outcome in the hands of the parties involved instead of a neutral third party.
