Considering Assisted Living
by: Legal Hotline for Older Iowans

September 2002

There are a variety of housing options available for older Iowans.  Deciding on a facility that provides the services needed and desired can be a difficult process.  By knowing the available resources and following a few simple suggestions, deciding on an appropriate arrangement can be less discouraging.

One type of housing is assisted living.  An assisted living program must provide housing and services to six or more tenants in a homelike environment. It must also provide either personal care or health related care.  Programs that do not offer at least
one of these services cannot present themselves as assisted living facilities.  Iowa law requires assisted living programs to be certified by the Iowa Department of Elder Affairs.  To get a list of certified facilities, call the Department of Elder Affairs at
515-281-5187.

When you are considering moving to an assisted living facility, it is important to visit as many facilities as possible.  Make time to meet the administrator, tour the facility, speak with current residents and staff, and receive as much literature as possible on the programs and services offered.  Think about the services you currently need in addition to those you may require in the future.  Services that are generally offered include meals, housekeeping, transportation, medical assistance, personal care, and social and recreational activities.  Assistance with daily activities such as bathing, hygiene, and walking may also be available.

Expense is another major consideration since there is little financial assistance available for assisted living.  In Iowa, you can expect to encounter monthly costs ranging from $1,000 to $3,000 per month.  You may also encounter facilities that require significant deposits.  You should ask about increases in monthly charges and services that are only provided for an additional fee.

Once you have decided on an assisted living facility, carefully review the tenant occupancy contract before you sign.  Make sure all verbal promises are in writing.  If the contract refers to other documents or attachments, read them as well.  Learn the conditions under which a facility can discharge you and how much notice the facility must give.  Also know the circumstances that will allow you to break the occupancy contract.  Be aware of the notice you must provide and any penalties you could be held responsible for if you do not provide notice.  If you have any questions concerning an assisted living contract or any other legal issue regarding Iowans over 60, please call the Legal Hotline for Older Iowans at 1-800-992-8161.
