A November 22, 2005 order by U.S. District Judge (Eastern District of Louisiana) Stanwood Duval gives some temporary relief to many renters facing eviction in Orleans and Jefferson Parishes.
Who does the order apply to? Pending (as of November 22nd) and future evictions in Jefferson and Orleans Parishes, where the tenants' whereabouts are unknown and who were living at the rented premises on or before August 29, 2005.
What relief does the order give? Rules for possession must be mailed to the tenant's current address as provided by FEMA. If FEMA reports that it has no address, the notice must be mailed to the tenant's last known address. Also, at least 45 days must go by after the Rule is mailed, before there can be trial on the Rule for Possession in court.
