Withholding Child Support from Payroll Checks
by: Child Support Enforcement Division
New Mexico Law 40-4A-8 allows child support to be taken out of a parent's payroll check.
No other legal claim (such as debt collection) may be taken from the payroll before the child support claim.
All child support withholding orders must be paid. The child support must be given according to need. No child receiving support will be left out. The payer may take back $1.00 for each withholding.
Helpful Tip: The laws about child support in New Mexico are found in the New Mexico Statutes Annotated, Chapter 40, Domestic Affairs. You can get help finding these laws from a law library.
