What is a quitclaim deed?

It is a deed that gives away any rights the person signing the deed might have to property described on the deed.  The deed does not guarantee that the person signing the deed has any rights to the property.

When should a person use a quitclaim deed?

It should be used whenever a person wants to give away his/her rights to the property and not give any promises about how good the title to the property is.

Where can I get a blank form for a quitclaim deed?

Most stationary stores sell blank deeds.  You can fill out the blank form with the information about the property (usually a legal description) and the person to whom you are giving the property.

Do I have to sign the deed in front of a notary public?

Yes.  The deed must be signed in front of a notary public in order for the deed to be recorded.  The deed should then be recorded/filed with the county clerk in the county where the property is located.

¿Qué es una escritura de renuncia a demanda?

Es una escritura en la que se renuncia a cualquier derecho que la persona que la firma, pudiera tener sobre la propiedad descrita.  La escritura no garantiza que la persona firmando la escritura tenga algún derecho sobre la propiedad. 

¿Cuándo debe una persona usar una escritura de renuncia a demanda?

Este tipo de escritura podrá usarse cuando una persona quiera renunciar a los derechos que tenga sobre una cierta propiedad, sin prometer o asegurar que el título sobre la propiedad sea bueno.

¿Adónde puedo conseguir una de estas escrituras?

Casi todas las librerías o papelerías venden estas escrituras en blanco.  Usted puede completarla con información sobre la propiedad (normalmente se usa una descripción legal) e información sobre la persona a quien usted este donando la propiedad.

¿Tengo que firmar ante un notario o escribano público?

Sí. La escritura debe ser firmada frente a un notario o escribano público para que quede un registro de ella.   Luego la escritura deberá registrarse/archivarse en la oficina del escribano o secretario de registros del condado (county clerk) adonde se encuentra la propiedad.
