The Right to All Your Wages On Time
If you work in agriculture and your work ends or you get fired from your job, your employer must pay you on your last day of work. If you quit without telling your employer, s/he has 48 hours, or until the next pay day if sooner, to pay you all of your wages. If you give at least 48 hours notice that you are going to quit, s/he must pay you on your last day of work.
If you request it, your employer must mail your pay check to the address that you give. You do not have to return to the job site to get your pay.
If you do not get paid on time when your work ends, the law allows you to get double the amount the employer owes you. In Oregon you might be able to get even more from him/her as a penalty. If you ask for your pay in writing and the employer does not pay you in 12 days, you may be able to get your daily wage (at least 7.25/hr. X 8 hours) for each day the pay is late, up to 30 days.
To ask for your pay in writing, you, your lawyer, or someone else on your behalf can write a simple letter to the employer that says the amount of money s/he owes you, that these wages are late and that you would like to get all your wages. Always put the date on the letter and keep a copy for yourself.
