Disclosing HIV Test Results

Q.If I test positive for HIV, who will know the results?
A.If you test positive for HIV, your test results will be known to the facility where your test was administered and to the Department of Health, which will create a permanent record of your HIV status.
Q.If I test positive, does my doctor have to give my name to the Department of Health?
A.Yes. Your doctor will report your name and status to Department of Health, which will create a permanent record and be recorded to the Center of Disease Control.
Q.If I am a student and I test positive, is my school informed?
A.No.
Q.If I test positive, does my doctor have to tell my spouse or sexual partner?
A.

No. The only person that your doctor can contact is the Department of Health. If you want your spouse or partner to know of your HIV status, but you are afraid that they may hurt you, there is the Partner Notification Act, in which the Department of Health! and its authorized representatives may interview any person infected with HIV, or anyone directly named as a contact to a known infected individual, for the express purpose of partner notification, which includes risk reduction, counseling, testing, and/or treatment, as the same might be deemed appropriate.

All information gathered in the course of partner notification shall be held confidential and shall be subject to the rules and regulations governing patient confidentiality promulgated by the Commissioner of Health. Any person who violates the provisions of the rules and regulations promulgated therefore, shall be fined up to $3000.00 for each offense and may be terminated form his position of employment.

 

Any person who is determined to be HIV infected, who may reveal the name or names of persons who they may have perceived to be at risk for HIV infection, especially of sexual contacts or needle-sharing partners, for the express purpose of facilitating partner notification, shall not be held liable in a civil action for such as revelation unless the revelation is made falsely or with reckless disregard for

the truth.

A.No.
Q.If I test positive, does my doctor have to tell my employer?
A.No.
Q.If I test positive, do I have to tell anyone when I have sex or share needles?
A.Yes. According to Virgin Islands law, whoever cohabits with another, knowing herself or himself to be afflicted with HIV/or any venereal disease, shall be fined not more that $100.00, or imprisoned not more than 180 days, or both.
