Making a will can be simple or complex, depending on many things.
This Website will answer basic questions about wills & probate. It does not tell you what is best for you.
If you are thinking about making a will, it is best to talk to a lawyer.
What is a will?
- A will is a legal paper. A will lets you plan for your death. It is a way of telling others what should happen when you die. In your will you can:
- Name people and groups, such as your kids, churches or hospitals, who you want to get money or land from you when you die;
- Name a person to take care of your kids who under age 18. (This person is called "guardian").
- Name somebody (called a "personal representative" or "executor") to handle matters after your death;
- In some cases, lessen or avoid estate taxes. Your will cannot do anything that is not legal. Give money or make plans for the care of a family member who has special needs;
By making plans, a will can make your death easier for those who survive.
Who can make a will?
- any person over age 18 can make a will in Wyoming. The maker must be of "sound mind", which means that he/she must know:
- what he/she owns and how much it is worth
- who he/she wants to leave it to
Who should make a will?
- every adult who owns or expects to own land or other property.
- anyone who is married and has kids.
- anyone who is 18 years or older.
