Minimum wage and overtime
by: Wyoming Legal Services - Lander Office
Wages and hours
The Fair Labor Standards Act (FLSA) protects almost all workers in the country. It covers the minimum wage, the 40-hour workweek, and overtime.
The minimum wage
The Wyoming minimum wage is $5.15/hour. People who get tips have a minimum wage $2.13/hour. If the tips and wages combined equal less than $5.15/hour, then the employer has to make up the difference.
Not all workers have to be paid the minimum wage. These are workers who get salaries.
The 40-hour workweek and overtime
A lot of people work more than 40 hours a week. After the 40th hour, many people get paid 150% of their normal wage. This is overtime. For instance, someone who normally makes $10/hour, gets paid $15/hour during overtime.
Who gets overtime?
- All workers who make less than $455/week or $23,660/year
- Workers who make more than $455/week or $23,660/year AND are paid by the hour
Who doesn't get overtime?
- Supervisors
- People in jobs that require higher learning such as teachers and scientists
- Creative jobs such as acting or writing
- Computer workers who make more than $455/week or $27.63/hour
Rest breaks
Wyoming does not require employers to give rest breaks.
