What if you change your mind?
You can stop the divorce before the judge has finalized it. Stopping a divorce is tricky, but it can be done.
Stopping the divorce
The person who started the divorce (the plaintiff) must agree to stop it. Sometimes the other spouse (the defendant0 has to agree too.
- If the defendant has NOT filed an answer, then the plaintiff can stop the divorce on her own.
- If the defendant has filed an answer, then BOTH spouses have to stop the divorce.
In either case, you have to go to the courthouse and file a "motion to dismiss." The clerk of the court may be able to help you get the right form.
This is tricky stuff, so you may want to ask a lawyer for help.
