RESIDENTIAL RENTAL AGREEMENT

THIS IS A LEGALLY BINDING AGREEMENT - READ IT CAREFULLY

Date:

_________________________ (LANDLORD) agrees to rent to

_________________________ (TENANT) the premises described as: ______________________________________________________

together with the following furniture and fixtures: oven / range, refrigerator and window coverings.

1. The rental shall commence on __________________ and shall continue to and be terminated only as agreed.

2. Receipt of $ ____________ dollars is hereby acknowledged as a cleaning and damage and security deposit for payment of utilities. This deposit may not be used by the Tenant to apply on rent due or about to become due. In the event the Tenant fails to give the required notice or pay the entire rent amount due when vacating, this deposit will not be refunded. Other deductions are referenced in items 19 & 20.

3. Tenant agree to pay the following utilities: electricity, gas, city.

4. Tenant has examined the premises and all furniture and fixtures contained herein and accepts the same as being clean and in good order, condition and repair.

5. The premises are rented for use only as a residence for a single family, not more than ___ adults and ___ children. No animals or pets shall be kept on the premises without the Landlord's written consent. REGULAR TENANTS shall be restricted to the following.

If any additional persons occupy the said premises, or part thereof, without Landlord's prior written consent, TENANT shall pay an additional rent, the sum of $200.00 per month for each additional person.

6. Tenant shall not disturb, annoy, endanger or inconvenience other tenants of the building or neighbors, nor use the premises for any immoral or unlawful purpose, nor violate any law or ordinance nor commit waste or nuisance upon or about the premises.

7. Tenant shall keep the premises rented for his exclusive use in good order and condition and pay for any repairs caused by his negligence or misuse or that of his guest in the event the damage deposit is insufficient to pay therefore.

8. Tenant shall neither paint nor make alterations of the property without Landlords prior written consent.

9. With Tenant's permission, which shall not unreasonably be withheld, Landlord or his agent shall be permitted to enter to inspect, or to make repairs and to show the premises to prospective tenants or purchasers. In an emergency, Landlord or his agents may enter the premises without securing prior permission from Tenant, but shall give Tenant notice of such entry immediately thereafter. Tenant acknowledges that if the property is offered for sale that Tenant agrees to cooperate with showing the property.

10. Tenant shall not let or sublet all or any part of the premises nor assign the agreement to any interest without prior written consent of Landlord.

11. If Tenant abandons or vacates the premises, Landlord may, at his option, immediately terminate this agreement, re-enter the premises, and remove all personal property.

12. The prevailing party may recover from the other party his costs and attorneyd fees incurred in any action brought by either party to enforce the terms of this agreement.

13. The Rental Agreement shall be terminated by either party upon 30-day written notice. Failure to do so shall constitute forfeiture of the deposit. NO PARTIAL MONTH'S RENTS ARE ACCEPTED.

14. Tenant agrees to keep the subject property in a clean and orderly condition, and adhere to terms and conditions herein and if Tenant fails to do so, Landlord or his agents may immediately terminate this rental agreement under Wyoming Statue Section 1-21-100WS 3WS 1977. This is a 3 day notice to quit.

15. Time is of essence. The waiver by Landlord of any breach shall not be construed to be a continuing waiver of any subsequent breach.

16. $_____ Monthly rent due in advance on the 1st day of each month. Checks shall be made payable to __________________ and delivered to_____________________________________________

17. The monthly rent is subject to change upon two- (2) week's notice by Landlord to Tenant.

18. LATE RENT PENALTY: Rent not paid in advance on the day it becomes due is considered delinquent and is subject to a late charge of five ($5.00) dollars PER DAY for each day thereafter that it is due. If late fees are not paid when due, those fees can be deducted from the deposit at the time of vacancy.

19. RETURNED CHECKS: A twenty ($20.00) dollar charge will be made for any checks returned by a bank. In the event of bank error, there will be no charge, provided Landlord receives the bank's written acknowledgment of such error. If the fee is not paid immediately it will be deducted from the deposit.

20. The Landlord shall not be held responsible for any latent defect for change in the condition of the premises, nor for any damages to said premises or to goods or other property contained therein, by any overflow or leakage upon or into the premises from water or from any other source and the rent shall not be diminished on account of any such defect, change or damage.

21. The Tenant agrees to cultivate, care for and adequately water lawn, trees and grounds. Tenant agrees to be liable and responsible for snow removal on all public sidewalks.

22. No unlicensed or inoperable vehicles will be kept upon the premises. The Landlord may have any or these vehicles towed away at the Tenant's expense.

23. Tenant acknowledges and accepts that if the property is offered for sale that Tenant agrees to cooperate with Landlord's agents in showing the property. If agents are unable to contact Tenant prior to showing, agents shall have permission to proceed and show the property.

24. All parties agree that, during said rental period, Landlord or their agents shall not be responsible for nor incur any costs associated with minor repairs including, but not limited to glazing, plumbing, electrical, appliances or any other specified in an amount of $75.00 or less.

25. Tenant(s) agree to provide and pay for a Tenants homeowners' policy  with a minimum of $100,000.00 liability coverage. A copy of the endorsement shall be provided to agents prior to occupancy. Tenants represent they are insured.

Damage Deposit Refund Policy

Your damage deposit will be refunded 30 days after check-out is completed. Amount of refund will be affected by the following guidelines.

1. Rent - All unpaid rent will be taken out of the deposit.

2. Utilities - You are responsible for all utilities. If these are not paid, these charges will be deducted.

3. Sub- Lease fee - There is a $25.00 fee for sub-leasing an apartment.

4. Damage - You are responsible for all damages to your apartment. You are responsible whether you or someone else causes these damages.

5. Carpet and Drapes - a $50.00 charge is automatically taken out of deposit for the cleaning of carpet and drapes.

6. Bad Check Fee - There is a charge of $20.00 on all returned checks. Once you have had a bad check, you must make all future payment with cash or a money order.

7. Late charges - Late charges not paid will be deducted from the deposit.

8. Cleaning - The cleaning charge is based upon $10.00 per hour for the amounts of time it takes to complete the cleaning.

9. Lawyer's fee - If there are any legal problems, lawyer's fees are paid by the tenant and these charges will be deducted from the deposit.

10. Keys - If all keys are not turned in, the lock will have to be changed and fee of $25.00 will be deducted from the deposit.

11. Inventory - You are responsible for all furniture that is in the apartment when you move in the apartment. If there is any furniture missing, you will be charged replacement costs.
