What must the creditor do?

  • Your creditor (the person who you owe money to) must send you a letter within 30 days of getting your notice.
  • If the problem if fixed, he does not need to send this letter.
  • If the problem is not fix, he as two billing cycles (but not more than 90 days), to look into the problem.
  • In this time he must correct the mistake or explain why your bill was right.

What happens while the creditor is looking into it?

     Once you send a notice, the bill is in what's called "dispute."

     The amount in dispute is the amount of the mistake you complain about.

     The amount in dispute may also include finance charges if the bill is found to be correct.

     While you are waiting for an answer, you don't have to pay. This includes finance charges.

  • You still have to pay any part of the bill that is correct. While the bill is in dispute, the creditor cannot send collection agents after you.
  • He cannot close your account. He cannot keep you from using it.
  • Your credit limit can be lowered by the amount in dispute.
