[1]REQUIREMENTS FOR FILING A BILL OF PARTICULARS

 

Part Seven B, General District Courts-Civil, Rule 7B:2 General Provisions as to

Pleadings

 

1 .            Original to be filed with the Court by plaintiff with a copy sent to the

defendant, or defendant’s attorney, not later than date set by the judge.

 

2.            A Bill of Particulars amplifies and explains the Warrant in Debt. It informs the opposing party fairly of the factual basis for the claim. State the facts supporting your claim that the defendant owes money and the facts supporting the amount of money sued for in the Warrant in Debt.

 

3.             A Bill of Particulars should not state a new and different cause of action or

a new amount above that claimed in the Warrant in Debt. It is not an

amendment to the Warrant in Debt.

 

4.             Corporate plaintiffs must have a lawyer to file a Bill of Particulars.

 

5.             Failure to file or failure to file by the date set by the Court may lead to

summary judgment against the plaintiff.
