Temporary Orders (for Support, Custody, Etc.)
Certain issues may need to be dealt with between the time a Petition is filed and the Divorce is granted. For example, one spouse may have concerns about finances or the welfare of the children. If so, a spouse may request temporary orders from the court for attorneys fees, temporary custody of the children, child support, visitation, or alimony. The right to sole occupancy of the family home can be ordered, but only if there has been domestic violence. Before the Court will rule on temporary matters, the need to have a hearing is likely. The courts follow guidelines to decide how much temporary child support should be ordered. To make a prompt decision, the guidelines determine temporary child support based on three things:
- the number of children
- the income of the parent with custody
- the income of the parent who does not have custody.
Click here to see the child support guidelines. The Iowa Supreme Court reviews these Guidelines every few years. The most recent review took place in 2004. Another review will take place in 2008.
