At times going to court to sue someone for money may not be the best way to handle a problem. This is especially true where a dispute stems from a simple misunderstanding. It could be between friends, neighbors, or family members. In those cases it may be better to consider going to mediation to try to work out your problems rather than going to court. The use of mediation is growing in Iowa. Mediation is a process for resolving disputes. It involves someone outside the dispute ? the mediator. The mediator does NOT make a decision about who should win. The mediator is there to help bring people together, reduce conflict, and open channels of communication.

In recent years there have been a growing number of mediation centers in the state. These centers try to handle problems without resorting to the courts. Mediation involves voluntary agreement by both sides to meet with a mediator and try to work out solutions to the problems. Mediation only works if both sides voluntarily agree to work with the mediator. No one gives up the right to go to court by going to mediation. Court is still an option if you are not satisfied with the mediator?s decision or if the other side backs out. However, there are usually deadlines for filing a suit in court which may expire if you wait too long.

Iowa now has several mediation groups that conduct mediation. At the present time, not all parts of the state have mediation centers. Iowa dispute settlement centers include the programs listed below. Many programs also serve neighboring counties or regions of the state. Fees or sliding fee scales may apply to their services.

You may be able to obtain details on mediation programs serving your area from the local Clerk of Court or The Iowa Association for Dispute Resolution, which can provide information on dispute resolution resources in the state. Contact:
