Welcome! This online interview was developed by the Legal Aid Society of Hawaii for use by low-income persons representing themselves, but is available free of charge to all persons. These forms are not for commercial use and charging for use in any way is prohibited.
Use this interactive interview if you would like to complete the court forms (Petition, Waiver of Notice, List of Exhibits, Order Appointing Guardian) for a Guardianship of an Incapacitated Person and if you will file your Guardianship in the First Circuit (Oahu). What do I need to get started?
It is helpful to gather the following information before starting the self-help interview:

A doctor's note or signed letters from other experts (social workers or therapists) proving that the Incapacitated Person ("Respondent") needs a guardian to make his/her legal decisions

Other evidence proving that the person is incapacitated and in need of a guardian
NOTE: In order to file for Guardianship, the incapacitated person must have been a resident of the State of Hawaii for at least six (6) months and a resident of the Island of Oahu for at least three (3) months.
